OwnShift – Terms of Service

These Terms of Service (β€œTerms”) govern your use of OwnShift (β€œOwnShift,” β€œwe,” β€œour,” β€œus”), including our website www.ownshift.work, WhatsApp Business account, applications, and related services (collectively, the β€œPlatform”). 

By creating an account or using the Platform, you agree to these Terms. If you do not agree, you may not use OwnShift.

Eligibility 

  • You must be at least 18 years old, or the age of majority in your jurisdiction. 
  • You must have the legal authority to enter into binding agreements. 
  • If you register on behalf of a company or organization, you confirm that you are authorized to bind that entity to these Terms. 


Account Registration
 

  • You must create an account to use most features of OwnShift. 
  • You agree to provide accurate, complete, and updated information during registration. 
  • You are responsible for keeping your login credentials confidential and secure. 
  • You are responsible for all activities carried out through your account. 
  • OwnShift may suspend or terminate accounts if false information is provided or if misuse is detected. 


Permitted Use of the Platform
 

You agree to use OwnShift only for lawful purposes. You may not: 

  • Use the Platform for illegal, fraudulent, or harmful activities. 
  • Post or share misleading, offensive, or defamatory content. 
  • Infringe on the intellectual property rights of others. 
  • Interfere with, disrupt, or attempt to hack our systems. 
  • Circumvent security or access controls. 


Relationship Between Clients and Freelancers
 

  • OwnShift.work is a marketplace platform. 
  • Freelancers are independent contractors, not employees of OwnShift. 
  • Clients and freelancers are free to define their own project terms (scope, deadlines, deliverables, pricing). 
  • Both parties are responsible for maintaining confidentiality of shared information. 


User Content
 

  • You retain ownership of all content you upload (profiles, portfolios, job postings, messages). 
  • By posting content, you grant OwnShift a limited, worldwide, non-exclusive license to display and use it to operate the Platform. 
  • You are responsible for ensuring your content does not violate laws or third-party rights. 
  • OwnShift may remove content that violates these Terms or applicable law. 


Reviews & Ratings
 

  • After completing a project, clients and freelancers may leave feedback. 
  • Feedback must be honest, fair, and respectful. 


Data Sharing Between Users
 

  • To facilitate collaboration, OwnShift may allow limited sharing of user data (e.g., username, profile, country, project activity). 
  • Freelancers may access client-provided project data as necessary for delivering services. 
  • Clients may access freelancer-provided portfolios, qualifications, and communication history. 
  • Both parties must handle shared data responsibly and comply with confidentiality agreements, if any. 


Termination of Accounts
 

  • You may close your account at any time. 
  • OwnShift may suspend or terminate your account if: 
  • You breach these Terms 
  • You misuse the Platform 
  • You engage in fraudulent, abusive, or harmful behavior 
  • Termination does not affect any obligations that arose before termination. 


Platform Availability & Disclaimer
 

  • OwnShift provides the Platform β€œas is” and β€œas available.” 
  • We do not guarantee uninterrupted or error-free operation. 
  • We make no promises about project outcomes, freelancer performance, or client reliability. 


Limitation of Liability
 

  • OwnShift is not responsible for disputes, damages, or losses arising from client-freelancer interactions. 
  • To the extent permitted by law, OwnShift is not liable for: 
  • Lost profits, business interruption, or data loss 
  • Indirect, incidental, or consequential damages 


Governing Law
 

  • These Terms are governed by the laws of India. 
  • Any disputes must be resolved in the courts of that jurisdiction. 


Changes to These Terms
 

  • OwnShift may update these Terms from time to time. 
  • Updates will be posted on this page with the new β€œLast Updated” date. 
  • Continued use of the Platform after changes means you accept the new Terms.
